Emily Moreno, the daughter of Sen. Bernie Moreno (R-Ohio), has filed for a new restraining order against her ex-husband, Rep. Max Miller (R-Ohio), whom she has accused of domestic violence.
In the request, dated Thursday, Emily Moreno alleged that Miller physically grabbed one of her attorneys, Andrew Zashin, during a hearing Tuesday and used a profane slur to insult Zashin’s fiancee as they were leaving the courtroom.
“Upon seeing Attorney Zashin begin to turn around, [Miller] continued to goad Attorney Zashin into a confrontation by saying ‘Come at me!’ or similar language,” Moreno said in the request.
“Unless restrained, [Miller] will continue to harass, threaten, and communicate with my counsel directly,” Moreno said.
Zashin declined to comment on Thursday and representatives for Miller did not immediately respond to requests from The Washington Post.
Miller and Moreno, who have been engaged in a bitter custody fight that has involved allegations of domestic abuse, already have restraining orders against one another. The two married in August 2022, had a daughter in November 2023 and divorced in June 2025. Miller, 37, is running for a third term representing Ohio’s 7th Congressional District.
Moreno accused Miller in court filings of throwing hot water on her from a pan of eggs he had just cooked in June 2024, on the day she said she planned to leave him. She said that caused her to fall to the floor and Miller afterward sprayed her with the sink hose.
Moreno has also accused Miller of physically abusing their 2-year-old daughter, who in February suffered a fractured collarbone with “a bruise that accompanies the injury that appears to be in a handprint and appears to have been inflicted,” according to a police report.

In the same report, Moreno told police that Miller allegedly once held a gun to her head and was physically abusive to her in front of their daughter.
Miller has denied all allegations of physical abuse against Moreno and his daughter, and suggested that his ex-wife was fabricating them because she was mentally ill.
“They’re false allegations,” Miller told Spectrum News last month.
Moreno’s attorneys have previously denied that she is mentally ill. Miller has also accused his ex-wife of domestic violence, but a judge formally dismissed Miller’s case against Moreno this week, finding that he “was not under any apparent infirmity and did not appear to have been threatened by or in fear of [his ex-wife].”
Miller also accused his former father-in-law in a post on X of “antics” and of funding and enabling “his daughter’s malicious campaign to ruin my life despite his knowledge of her mental health issues.”
Sen. Bernie Moreno, who, like Miller, is a close ally of President Donald Trump, had before Thursday not publicly commented on his daughter’s allegations against her ex-husband.
In a statement Thursday, Reagan McCarthy, the senator’s spokesperson, said that his “top priority is the safety and well-being of his daughter and granddaughter.”
“While he does not litigate these matters in the media or respond to baseless public attacks, he will do whatever it takes to ensure a just outcome for his family,” McCarthy said.
