Many have already expressed a desire to get a cut of the money, including people charged in the Jan. 6, 2021, attack on the U.S. Capitol.<\/p>\n<p>But the fund has provoked outrage and criticism from legal analysts and ethics watchdogs, with Donald K. Sherman, president of Citizens for Responsibility and Ethics in Washington, saying it could be used to pay off Trump\u2019s allies and calling it \u201cone of the single most corrupt acts in American history.\u201d<\/p>\n<p>The pushback extended to Capitol Hill, where <a href=\"https:\/\/www.washingtonpost.com\/national-security\/2026\/05\/19\/blanche-faces-capitol-hill-grilling-18b-anti-weaponization-fund\/\" rel=\"\" target=\"_self\" title=\"https:\/\/www.washingtonpost.com\/national-security\/2026\/05\/19\/blanche-faces-capitol-hill-grilling-18b-anti-weaponization-fund\/\">bipartisan skepticism<\/a> of the deal bubbled over this week. On Thursday, Senate Republicans grilled Todd Blanche, the acting attorney general, with questions about the fund. Republicans then  <a href=\"https:\/\/www.washingtonpost.com\/business\/2026\/05\/21\/trump-appears-be-losing-his-grip-senate\/\" rel=\"\" target=\"_self\" title=\"https:\/\/www.washingtonpost.com\/business\/2026\/05\/21\/trump-appears-be-losing-his-grip-senate\/\">delayed plans to pass extra funding<\/a> for immigration enforcement agencies amid  frustrations over the issue.<\/p>\n<p>But while controversy has raged, significant \u2014 and basic \u2014 details about the fund remain unknown.<\/p>\n<p>The payout fund was created through <a href=\"https:\/\/www.washingtonpost.com\/national-security\/2026\/05\/18\/trump-will-end-10-billion-lawsuit-against-irs-over-leaked-tax-records\/\" rel=\"\" target=\"_self\" title=\"https:\/\/www.washingtonpost.com\/national-security\/2026\/05\/18\/trump-will-end-10-billion-lawsuit-against-irs-over-leaked-tax-records\/\">an agreement<\/a> Trump reached with the IRS to resolve <a href=\"https:\/\/www.washingtonpost.com\/politics\/2026\/01\/29\/trump-sues-irs-tax-return-10-billion\/\" rel=\"\" target=\"_self\" title=\"https:\/\/www.washingtonpost.com\/politics\/2026\/01\/29\/trump-sues-irs-tax-return-10-billion\/\">a lawsuit<\/a> he had filed after his tax returns were <a href=\"https:\/\/www.washingtonpost.com\/dc-md-va\/2024\/01\/29\/irs-contractor-leak-trump-taxes-sentence\/\" rel=\"\" target=\"_self\" title=\"https:\/\/www.washingtonpost.com\/dc-md-va\/2024\/01\/29\/irs-contractor-leak-trump-taxes-sentence\/\">leaked by a contractor<\/a> during his first term.<\/p>\n<p>Trump has defended the fund, <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/116618545735076530\" rel=\"\" target=\"_self\" title=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/116618545735076530\">writing<\/a> on social media Friday that he could have settled \u201cfor an absolute fortune\u201d but instead was \u201chelping others, who were so badly abused by an evil, corrupt, and weaponized Biden Administration.\u201d<\/p>\n<p>Much of what is known about the fund so far comes largely from the terms of the agreement laid out in a dozen pages released by the Justice Department, along with public comments from Blanche.<\/p>\n<p>The <a href=\"https:\/\/www.justice.gov\/opa\/media\/1441201\/dl?inline\" rel=\"\" target=\"_self\" title=\"https:\/\/www.justice.gov\/opa\/media\/1441201\/dl?inline\">written agreement<\/a> offers few assurances that the fund\u2019s actions and decisions would be made public. Scott Applewhite\/AP)<\/figcaption>\n<\/figure>\n<p>Under these terms, decisions made by the administration\u2019s handpicked panel members will be irreversible, with no appeal process, and not subject to any judicial oversight.<b> <\/b>Claims submitted to the fund can be audited, the document states, but only by the Justice Department or a contractor \u201cdesignated by the Attorney General.\u201d<\/p>\n<p>The administration has not gone into detail about who might be selected to join the five-member panel tasked with doling out the funds, nor have officials laid out a process for how people can submit complaints or how they will be weighed. The Justice Department did not respond to a request for comment about these issues.<b> <\/b><\/p>\n<p>Rupa Bhattacharyya, legal director of Georgetown Law\u2019s Institute for Constitutional Advocacy and Protection, said she was concerned by the fund\u2019s origins, structure and lack of oversight.<\/p>\n<p>\u201cThere\u2019s absolutely no criteria or guidelines created for who is eligible, what sorts of injuries might be compensable and how much compensation might be given,\u201d said Bhattacharyya, who previously worked as special master for the September 11th Victim Compensation Fund. \u201cIn every other fund I have been involved with, all of which were created by Congress, by statute, those sorts of criteria are outlined. And the lack of any sort of guardrails here makes it really concerning, particularly given the amount of money.\u201d<\/p>\n<p>\u201cI have no sense of how this will work in practice,\u201d she said.<\/p>\n<p>According to the <a href=\"https:\/\/www.justice.gov\/opa\/media\/1441201\/dl?inline\" rel=\"\" target=\"_self\" title=\"https:\/\/www.justice.gov\/opa\/media\/1441201\/dl?inline\">settlement agreement<\/a> released by the Justice Department and a <a href=\"https:\/\/www.justice.gov\/opa\/media\/1441086\/dl?utm_medium=email&amp;utm_source=govdelivery\" rel=\"\" target=\"_self\" title=\"https:\/\/www.justice.gov\/opa\/media\/1441086\/dl?utm_medium=email&amp;utm_source=govdelivery\">two-page document<\/a> signed by Blanche, the Trump administration will move $1.776 billion \u2014 an apparent nod to the year of the nation\u2019s founding \u2014 into \u201can account for the sole use by the Anti-Weaponization Fund.\u201d<\/p>\n<p>This sum will come from the Treasury Department\u2019s Judgment Fund, an uncapped, taxpayer-funded pot of money intended to pay legal settlements and court judgments against the federal government.<\/p>\n<p>The new fund will have five members appointed by Blanche, the documents say, one of them \u201cchosen in consultation with congressional leadership.\u201d The documents do not explain the nature of this consultation.<\/p>\n<p>The agreement says Blanche has to pick the group\u2019s members within 30 days. <a href=\"https:\/\/www.washingtonpost.com\/national-security\/2026\/05\/19\/blanche-faces-capitol-hill-grilling-18b-anti-weaponization-fund\/\" rel=\"\" target=\"_self\" title=\"https:\/\/www.washingtonpost.com\/national-security\/2026\/05\/19\/blanche-faces-capitol-hill-grilling-18b-anti-weaponization-fund\/\">Blanche testified on Capitol Hill on Tuesday<\/a> that it was too soon to discuss who might be under consideration, though he later said \u201cseveral people\u201d had applied.<\/p>\n<p>\u201cWe want people who will have the ability to evaluate whether somebody who\u2019s applying for compensation is entitled to it \u2014 what amount and how to go about doing that,\u201d he told members of the Senate Appropriations Committee.<\/p>\n<p>Among those who have raised their hands is Mike Howell, president of the Oversight Project, a watchdog group. My colleagues and I are steeled for this fight.\u201d<\/p>\n<p>Once people are selected to work on the fund, the agreement released by the Trump administration says, they can leave their posts one of two ways: resigning or being forced off by Trump, who can oust any of them \u201cwithout cause.\u201d<\/p>\n<p>When the group makes decisions, few people will need to weigh in, according to the Justice Department\u2019s documents. Three members will constitute a quorum, they say, and \u201ca majority of a quorum is authorized to take action.\u201d<\/p>\n<p>Exactly how they will take action, though, is unclear. The settlement agreement says the fund\u2019s members will be able to determine their own processes for examining, granting or rejecting claims.<\/p><p>Read more <a href=\"https:\/\/movinginsiderusa.com\/?p=1249\">Stevens, Rumfield help Rockies rally past Diamondbacks for a 3-2 win<\/a><\/p>\n<p>But they will have immense latitude, the agreement says, able to give out money, fully accept or reject claims, issue apologies, delay acting on some allegations, and seek supporting evidence.<\/p>\n<p>The agreement lays out some of how this process could work. Anyone petitioning the group will have to \u201cassert at least one legal claim stating that the claimant was a victim of Lawfare and\/or Weaponization,\u201d it states.<\/p>\n<p>The group then has to weigh \u201cthe totality of the circumstances,\u201d the document continues, including the actions taken by people submitting claims, their \u201cactual damages,\u201d and unspecified \u201cother factors\u201d deemed \u201cjust and appropriate.\u201d<\/p>\n<p>The agreement also portrays these decisions as ironclad, saying that there will be \u201cno appeal, arbitration, or judicial review.\u201d<\/p>\n<p>What, if anything, is made public about these decisions remains to be seen. The agreement states that the fund\u2019s members have to send the attorney general \u201ca confidential written report\u201d once a quarter with the names and addresses of people who were given relief and what they received. There is no requirement listed that these details be made public.<\/p>\n<p>During his Tuesday appearance on Capitol Hill, Blanche said that some information from these reports had to be shielded to protect people\u2019s privacy, but he pledged \u201cfull transparency\u201d otherwise.<\/p>\n<p>\u201cThere\u2019s privacy laws that exist, so I don\u2019t want to sit here today and say every scintilla of data will be released,\u201d he said. \u201cBut I very much anticipate that the claims that are awarded \u2014 the basis and the amount \u2014 will for sure be made public along the way.\u201d<\/p>\n<p>The attorney general is not, however, required to release the details. And the quarterly reports called for<b> <\/b>in the agreement would address only the people who received relief from the fund, not anyone who had been rejected or had claims pending.<\/p>\n<p>Much of this information appears in a document labeled a \u201cSettlement Agreement,\u201d which was signed by Trump\u2019s personal lawyers as well as top officials with the Justice Department and the IRS.<\/p>\n<p>But the document was not submitted to the judge who had been overseeing Trump\u2019s lawsuit against the IRS.<\/p>\n<p>Trump, two of his sons and his family business filed a suit against the agency in January. (Drew Angerer\/Getty Images)<\/figcaption>\n<\/figure>\n<p>U.S. District Judge Kathleen Williams in South Florida, who had been overseeing the lawsuit, had questioned whether the parties were \u201csufficiently adverse,\u201d because Trump was both a plaintiff and the president overseeing the agencies he was suing.<\/p>\n<p>Williams, who was appointed by President Barack Obama, had asked for briefs from Trump\u2019s lawyers and the IRS by Wednesday. Instead, two days beforehand, Trump\u2019s lawyers <a href=\"https:\/\/movinginsiderusa.com\/wp-content\/uploads\/2026\/05\/39e74b02a56587cd4c58e209a7384d4f.pdf\" rel=\"\" target=\"_self\" title=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.706172\/gov.uscourts.flsd.706172.52.0_6.pdf\">moved<\/a> to voluntarily dismiss the case. No mention was made of any settlement. The same day, the Justice Department <a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-announces-anti-weaponization-fund\" rel=\"\" target=\"_self\" title=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-announces-anti-weaponization-fund\">announced<\/a> the nearly $1.8 billion fund.<\/p>\n<p>Williams dismissed and closed the case but <a href=\"https:\/\/movinginsiderusa.com\/wp-content\/uploads\/2026\/05\/b8a73a2c574b4c40ef7f3b39e028a381.pdf\" rel=\"\" target=\"_self\" title=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.706172\/gov.uscourts.flsd.706172.62.0_6.pdf\">noted<\/a> that there was \u201cno settlement of record,\u201d because nothing of the sort was included in the dismissal notice.<\/p>\n<p>The Justice Department has said Trump will get an apology but no money from the fund. The agreement also states that Trump will withdraw two other legal claims he had filed against the government seeking hundreds of millions of dollars.<\/p>\n<p>An <a href=\"https:\/\/www.justice.gov\/opa\/media\/1441216\/dl\" rel=\"\" target=\"_self\" title=\"https:\/\/www.justice.gov\/opa\/media\/1441216\/dl\">addendum<\/a> posted the day after the agreement was released \u2014 and also signed by Blanche \u2014 said the IRS was blocked from pursuing claims against Trump, his relatives or his businesses that preceded the settlement. It does not include any language limiting future audits.<\/p>\n<p>The Trump administration, in an apparent effort to preempt criticism, has sought to portray the fund as in line with previous government settlements.<\/p>\n<p>The Justice Department has pointed multiple times to <a href=\"https:\/\/www.washingtonpost.com\/wp-dyn\/content\/article\/2010\/10\/19\/AR2010101905654.html?itid=lk_interstitial_manual_10\" rel=\"\" target=\"_self\" title=\"https:\/\/www.washingtonpost.com\/wp-dyn\/content\/article\/2010\/10\/19\/AR2010101905654.html?itid=lk_interstitial_manual_10\">a $760 million fund<\/a> created through a settlement the Obama administration reached to resolve claims of discrimination by Native American farmers and ranchers.<\/p>\n<p>But there are significant differences between the two matters, including that Obama was not part of the lawsuit. And when that settlement was reached, it was submitted to a federal judge.<\/p>\n<p>When District Judge Emmet G. Sullivan in D.C. gave it final approval, he wrote that the settlement \u201cwas attained following an extensive investigation of the facts and the law.\u201d<\/p>\n<p>In Trump\u2019s case, the administration announced that it had reached a settlement before the federal government even responded to the president\u2019s claims. Ed Whelan, a conservative legal scholar, <a href=\"https:\/\/x.com\/EdWhelanEPPC\/status\/2056414246112465322\" rel=\"\" title=\"https:\/\/x.com\/EdWhelanEPPC\/status\/2056414246112465322\">posted<\/a> on social media that approval by a judge \u201cprovides some process protection against abuses.
