(Bonnie Jo Mount\/The Washington Post)<\/figcaption>\n<\/figure>\n<p>The head of a federal commission reviewing President Donald Trump\u2019s planned 250-foot triumphal arch said Thursday that he believed a federal law limiting the height of construction in Washington should not apply to the controversial project.<\/p>\n<p>Will Scharf, the Trump-appointed chairman of the National Capital Planning Commission, said that he had \u201cthought deeply\u201d about whether the Height of Buildings Act, which was enacted in 1910 and intended to preserve the capital city\u2019s historical views and character, should apply to the project. The law restricts<b> <\/b>most construction in Washington to a maximum height of 130 feet, and the commission has <a href=\"https:\/\/www.ncpc.gov\/about\/authorities\/hoba\/\" rel=\"noreferrer\" target=\"_blank\" title=\"https:\/\/www.ncpc.gov\/about\/authorities\/hoba\/\">historically applied the law<\/a> when deciding whether to approve projects in the region.<\/p>\n<p>But Scharf said he was skeptical of long-accepted legal arguments about the Height Act\u2019s applicability to the arch and other federal projects. He cited examples of Washington-area construction, such as the 166-foot-tall National Archives building on Pennsylvania Avenue, that exceed the law\u2019s limits.<\/p>\n<p>\u201cI believe, speaking personally, that the best reading of the law is that the Height of Buildings Act is not applicable to federal construction,\u201d Scharf said, as the commission prepared to receive public comments on the planned arch.<\/p>\n<p>The commission later voted to advance the project but did not bestow its final approval. The administration, which <a href=\"https:\/\/www.washingtonpost.com\/politics\/2026\/05\/20\/trump-officials-plan-build-arch-without-congressional-authorization\/\" rel=\"noreferrer\" target=\"_blank\" title=\"https:\/\/www.washingtonpost.com\/politics\/2026\/05\/20\/trump-officials-plan-build-arch-without-congressional-authorization\/\">does not believe it needs congressional authorization<\/a> for the project, has said it will provide at least 14 days\u2019 notice before beginning construction of the arch.<\/p>\n<p>Trump has prioritized the planned arch, saying that the 250-foot-tall structure should be constructed as part of the nation\u2019s 250th-anniversary celebrations. The Commission of Fine Arts, another panel that Trump has packed with allies, voted last month to <a href=\"https:\/\/www.washingtonpost.com\/politics\/2026\/05\/21\/commission-fine-arts-approves-trump-250-foot-triumphal-arch\/\" rel=\"noreferrer\" target=\"_blank\" title=\"https:\/\/www.washingtonpost.com\/politics\/2026\/05\/21\/commission-fine-arts-approves-trump-250-foot-triumphal-arch\/\">approve the project<\/a>, which would be built in Memorial Circle, a traffic roundabout at one end of Arlington Memorial Bridge tucked inside the boundaries of Washington.<\/p>\n<p>The project is being steered by the Interior Department, and Nicolas Leo Charbonneau, a classical architect at Harrison Design,<b> <\/b>is<b> <\/b>overseeing the arch\u2019s design.<\/p>\n<p>Architects, historical preservationists and Washington residents warned the planning commission Thursday that the arch would tower over nearby monuments \u2014 including the Lincoln Memorial, which is about 100 feet tall \u2014 with several speakers invoking the city\u2019s height rules.<\/p>\n<p>The arch is \u201cinconsistent with the Height of Buildings Act that protects the plan of the city,\u201d said Carol Quillen, chief executive of the National Trust for Historic Preservation. The organization, which is charged by Congress with helping preserve historical buildings, is <a href=\"https:\/\/www.washingtonpost.com\/politics\/2025\/12\/12\/trump-ballroom-lawsuit-construction\/\" rel=\"noreferrer\" target=\"_blank\" title=\"https:\/\/www.washingtonpost.com\/politics\/2025\/12\/12\/trump-ballroom-lawsuit-construction\/\">suing the Trump administration<\/a> over the president\u2019s planned White House ballroom.<\/p><p>Read more <a href=\"https:\/\/movinginsiderusa.com\/?p=2756\">Braves add depth at catcher by acquiring veteran Austin Wynns from Angels, DFA Chadwick Tromp<\/a><\/p>\n<p>Career staff on the planning commission also have questioned how the proposed arch would comply with the federal law restricting the height of construction.<\/p>\n<p>\u201cNCPC has always applied the Height of Buildings Act to federal projects,\u201d the commission\u2019s staff wrote in a <a href=\"https:\/\/movinginsiderusa.com\/wp-content\/uploads\/2026\/06\/09d87191ed4042b63c5c2e4fd66ff870.pdf\" rel=\"noreferrer\" target=\"_blank\" title=\"https:\/\/www.ncpc.gov\/docs\/actions\/2026June\/8778_New_Monumental_Arch_Staff_Report_Jun2026.pdf\">report<\/a> released ahead of Thursday\u2019s hearing, asking the Interior Department to justify its project in light of the height restrictions.<\/p>\n<p>Scharf, who<b> <\/b>is also Trump\u2019s staff secretary, said he supported that request and hoped that the response would \u201cprovide clarity\u201d on the legal issues involving the Height Act and Trump\u2019s planned arch.<\/p>\n<p>The Interior Department previously has said that it is working with the Federal Aviation Administration to determine whether the arch would pose any new safety risks, given its proximity to Reagan National Airport.<\/p>\n<p>The majority of the public opposes the project, which is also the subject of a lawsuit brought by <a href=\"https:\/\/www.washingtonpost.com\/politics\/2026\/02\/19\/trump-arch-250-lawsuit\/\" rel=\"\" title=\"https:\/\/www.washingtonpost.com\/politics\/2026\/02\/19\/trump-arch-250-lawsuit\/\">several military veterans<\/a> who say the towering structure would alter their visiting experience to nearby Arlington National Cemetery.
