(Ajit Solanki\/AP)<\/figcaption>\n<\/figure>\n<p>The Justice Department is preparing<b> <\/b>to seek the dismissal within days of<b> <\/b>a pending bribery and fraud case against Indian billionaire Gautam Adani, potentially<b> <\/b>ending <a href=\"https:\/\/www.washingtonpost.com\/national-security\/2024\/11\/20\/india-billionaire-gautam-adani-narendra-modi\/\" rel=\"\" target=\"_blank\" title=\"https:\/\/www.washingtonpost.com\/national-security\/2024\/11\/20\/india-billionaire-gautam-adani-narendra-modi\/\">its efforts to prosecute<\/a> one of Asia\u2019s richest men following a concerted defense campaign<b> <\/b>led by one of President Donald Trump\u2018s personal attorneys.<\/p>\n<p>That likely move<b> <\/b>was detailed by three people familiar with the matter, who spoke to The Washington Post on the condition of anonymity because they were not authorized to publicly discuss the matter.<\/p>\n<p>Though they cautioned that the decision could still change, those people described the plans to withdraw the indictment and resolve a parallel civil suit filed by the U.S. Securities and Exchange Commission as at an advanced stage.<b> <\/b><\/p>\n<p>The criminal case, lodged during the final months of the Biden administration, accused Adani and several executives at one of his businesses of paying millions to Indian government officials to secure energy supply contracts in that country while deceiving U.S. investors through publicly espousing an anti-bribery stance. Adani, a close ally of Indian Prime Minister Narendra Modi, has denied the allegations.<b> <\/b><\/p>\n<p>Discussion around potentially dropping the charges first gained traction after the Indian billionaire hired a legal team led by Robert J. Giuffra Jr., a top New York litigator and co-chair of the Manhattan law firm Sullivan &amp; Cromwell. Giuffra represents Trump in the president\u2019s appeals of his<b> <\/b><a href=\"https:\/\/www.washingtonpost.com\/politics\/2024\/05\/30\/trump-guilty-verdict-hush-money-trial\/\" rel=\"\" target=\"_blank\" title=\"https:\/\/www.washingtonpost.com\/politics\/2024\/05\/30\/trump-guilty-verdict-hush-money-trial\/\">hush money conviction<\/a> as well as <a href=\"https:\/\/www.washingtonpost.com\/politics\/2024\/02\/16\/judge-engoron-ruling-trump-ny-civil-fraud-trial\/\" rel=\"\" target=\"_blank\" title=\"https:\/\/www.washingtonpost.com\/politics\/2024\/02\/16\/judge-engoron-ruling-trump-ny-civil-fraud-trial\/\">a civil fraud case<\/a> brought by New York Attorney General Letitia James (D).<\/p>\n<p>Last month, Giuffra and his team met with top Justice Department officials in D.C., hoping to convince them that the criminal case and SEC lawsuit against Adani would not hold up in court, according to two of the people familiar with those discussions.<\/p>\n<p>As part of that presentation, the people said, the defense team<b> <\/b>also cited <a href=\"https:\/\/x.com\/gautam_adani\/status\/1856679498311184665?s=46\" rel=\"\" target=\"_blank\" title=\"https:\/\/x.com\/gautam_adani\/status\/1856679498311184665?s=46\">a pledge Adani made<\/a> shortly before he was charged in which he praised Trump for his 2024 election victory and offered to invest $10 billion in the U.S. economy and create 15,000 jobs.<\/p>\n<p>That<b> <\/b>meeting followed a similar and unsuccessful pitch by Adani\u2019s defense last year. Though such meetings between prosecutors and defense attorneys are not uncommon, the Justice Department decided at that point not to drop the case, according to<b> <\/b>one of the people familiar with the negotiations. Giuffra\u2019s firm was not involved in that earlier effort, and was hired later in the year.<\/p>\n<p>While the Justice Department has not yet filed any formal motion to dismiss the criminal indictment, SEC lawyers late Thursday asked a federal judge in Brooklyn to approve an $18 million settlement that would end its lawsuit against Adani and the others named as defendants in the civil case.<\/p>\n<p>Under <a href=\"https:\/\/movinginsiderusa.com\/wp-content\/uploads\/2026\/05\/1b30160ce7b5816b094955bffbbd3c9b.pdf\" rel=\"\" target=\"_blank\" title=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nyed.524060\/gov.uscourts.nyed.524060.34.0.pdf\">the terms of that proposed deal<\/a>, Adani would agree to pay $6 million in financial penalties. His nephew, Sagar, also a defendant in the case, has agreed to pay fines of $12 million, SEC lawyers said.<b> <\/b>Neither man would admit wrongdoing as part of the settlement agreement.<b> <\/b><\/p>\n<p>In addition to the SEC penalties, Adani\u2019s company, the Adani Group, is also expected to face fines of up to $275 million from the Treasury Department, which has separately been investigating allegations that Adani\u2019s firms have violated U.S. sanctions by shipping gas from Iran, according to the two people familiar with the negotiations.<b> <\/b><\/p>\n<p>Giuffra and the U.S. attorney\u2019s office in Brooklyn, which is overseeing the criminal case, declined to comment as did the SEC. Spokespersons for Adani, his nephew and the Justice and Treasury departments did not return requests for comment on the potential deal, which was first reported Thursday by <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2026-05-14\/us-authorities-moving-to-end-fraud-cases-against-gautam-adani?accessToken=eyJhbGciOiJIUzI1NiIsInR5cCI6IkpXVCJ9.eyJzb3VyY2UiOiJTdWJzY3JpYmVyR2lmdGVkQXJ0aWNsZSIsImlhdCI6MTc3ODc2ODM1OCwiZXhwIjoxNzc5MzczMTU4LCJhcnRpY2xlSWQiOiJURjBWOFRLR0lHNEIwMCIsImJjb25uZWN0SWQiOiI2MkFBOUVBNTMzQjI0MDcwQUU3RjlFMDJBMzU3NUNEMyJ9.ZX1fcAHaNpXX4tfYAjQe32IJT5tYD32CcQH174iBvaY&amp;leadSource=uverify%20wall\" rel=\"\" target=\"_blank\" title=\"https:\/\/www.bloomberg.com\/news\/articles\/2026-05-14\/us-authorities-moving-to-end-fraud-cases-against-gautam-adani?accessToken=eyJhbGciOiJIUzI1NiIsInR5cCI6IkpXVCJ9.eyJzb3VyY2UiOiJTdWJzY3JpYmVyR2lmdGVkQXJ0aWNsZSIsImlhdCI6MTc3ODc2ODM1OCwiZXhwIjoxNzc5MzczMTU4LCJhcnRpY2xlSWQiOiJURjBWOFRLR0lHNEIwMCIsImJjb25uZWN0SWQiOiI2MkFBOUVBNTMzQjI0MDcwQUU3RjlFMDJBMzU3NUNEMyJ9.ZX1fcAHaNpXX4tfYAjQe32IJT5tYD32CcQH174iBvaY&amp;leadSource=uverify%20wall\">Bloomberg News<\/a>.<\/p>\n<p>A move to<b> <\/b>withdraw the criminal case would serve as one of the highest-profile examples to date of the Justice Department\u2019s <a href=\"https:\/\/www.washingtonpost.com\/national-security\/2025\/04\/11\/smartmatic-fcpa-trump-voting-machines\/\" rel=\"\" target=\"_blank\" title=\"https:\/\/www.washingtonpost.com\/national-security\/2025\/04\/11\/smartmatic-fcpa-trump-voting-machines\/\">retreat from foreign bribery prosecutions<\/a> since Trump\u2019s return to the White House last year.<\/p>\n<p>It would also mark the latest instance of the Trump administration\u2019s <a href=\"https:\/\/www.washingtonpost.com\/national-security\/2025\/02\/14\/justice-prosecutors-resignation-trump-eric-adams-corruption\/\" rel=\"\" target=\"_blank\" title=\"https:\/\/www.washingtonpost.com\/national-security\/2025\/02\/14\/justice-prosecutors-resignation-trump-eric-adams-corruption\/\">reversing a Biden-era prosecutorial decision<\/a> at the urging of <a href=\"https:\/\/www.cbsnews.com\/news\/trump-pardon-recipients-democrats-congressional-investigation-pay-to-play\/\" rel=\"\" target=\"_blank\" title=\"https:\/\/www.cbsnews.com\/news\/trump-pardon-recipients-democrats-congressional-investigation-pay-to-play\/\">outside lawyers<\/a> close to the president <a href=\"https:\/\/abcnews.com\/US\/doj-drops-charges-client-ag-pam-bondis-brother\/story?id=125073335\" rel=\"\" target=\"_blank\" title=\"https:\/\/abcnews.com\/US\/doj-drops-charges-client-ag-pam-bondis-brother\/story?id=125073335\">or his allies<\/a>.<\/p>\n<p>The 64-year-old Adani \u2014 who amassed a fortune estimated to be worth more than $104 billion as head of the Adani Group, a conglomerate with holdings in ports, coal mines and airports \u2014 was indicted in October 2024 by a federal grand jury in Brooklyn on charges of wire and securities fraud and conspiracy to violate the Foreign Corrupt Practices Act.<\/p>\n<p><a href=\"https:\/\/movinginsiderusa.com\/wp-content\/uploads\/2026\/05\/6870073dd3c1555e321e5da4d14f7647.pdf\" rel=\"\" target=\"_blank\" title=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nyed.522757\/gov.uscourts.nyed.522757.1.0_2.pdf\">Prosecutors<i> <\/i>alleged<\/a> he, his nephew and other executives of a renewable energy company promised more than $250 million in bribes to Indian government officials to secure solar energy supply contracts projected to make the business $2 billion in profits over a two-decade period.<\/p><p>Read more <a href=\"https:\/\/movinginsiderusa.com\/?p=313\">Vingegaard conquers Blockhaus mountain for first Giro d\u2019Italia stage win<\/a><\/p>\n<p>Government lawyers also accused the executives of lying to U.S. investors and international financial institutions through false representations about those agreements. The allegations in the SEC lawsuit largely mirrored those in the Justice Department\u2019s indictment.<\/p>\n<p>At the time, Adani\u2019s<b> <\/b>company dismissed the charges as \u201cbaseless\u201d and vowed to fight them with \u201call possible legal recourse.\u201d<\/p>\n<p>Adani himself addressed the matter during a 2024 speech.<\/p>\n<p>\u201cIn today\u2019s world, negativity spreads faster than facts, and as we work through the legal process, I want to reconfirm our absolute commitment to world class regulatory compliance,\u201d he said.<\/p>\n<p>But because they live outside the U.S., neither Adani nor his nephew have appeared in court or entered a plea to the U.S. charges, effectively stalling the case from the start.<\/p>\n<p>That has not stopped the prosecution from becoming a point of friction between the U.S. and India, a relationship that has also <a href=\"https:\/\/www.washingtonpost.com\/world\/2026\/01\/27\/indian-european-union-free-trade-agreement\/\" rel=\"\" target=\"_blank\" title=\"https:\/\/www.washingtonpost.com\/world\/2026\/01\/27\/indian-european-union-free-trade-agreement\/\">seen recent strain<\/a> over the Trump administration\u2019s aggressive trade policies and attempts to impose sweeping tariffs on Indian goods.<b> <\/b><\/p>\n<p>Political ties between Adani and Modi, India\u2019s leader, stretch back more than two decades. Both men hail from the western state of Gujarat, and Adani was an early champion of Modi\u2019s political ambitions. As Modi ran to become prime minister in 2014, he shuttled between campaign stops on an Adani Group jet, and the conglomerate has played a central role in his vision for a modern, globally competitive India.<\/p>\n<p>The company\u2019s holdings in airports and seaports account for a significant portion of India\u2019s passenger traffic capacity. And Modi\u2019s rise as a leader on the international stage has mirrored Adani\u2019s efforts to expand into more global ventures.<\/p>\n<p>Since Adani\u2019s indictment, Indian hard-liners have urged the Modi government to more forcefully oppose the U.S. prosecution.<\/p>\n<p>However, the Indian prime minister has said he did not discuss Adani\u2019s case with Trump when they met for a White House summit last year. At the time, Modi characterized his ally\u2019s legal troubles<b> <\/b>as a personal issue, not a matter of state.<\/p>\n<p>Meanwhile, the pending cases against Adani in the U.S. have limited his ability to travel internationally, and endangered his ambitious domestic and overseas plans, which have often overlapped with Modi\u2019s development agenda.<\/p>\n<p>Since his return to the White House, Trump has pushed the Justice Department to curtail prosecutions involving such foreign bribery allegations.<\/p>\n<p>The president has long maintained that U.S. laws barring companies from making payoffs to officials overseas to obtain business hinders the ability of American companies to compete in foreign markets where such transactions are common.<\/p>\n<p>Though the Justice Department in recent months has reviewed and abandoned several pending foreign bribery cases it has allowed others \u2014 including one against the <a href=\"https:\/\/www.washingtonpost.com\/national-security\/2026\/03\/10\/smartmatic-trump-vindictive-prosecution-claim\/\" rel=\"\" target=\"_blank\" title=\"https:\/\/www.washingtonpost.com\/national-security\/2026\/03\/10\/smartmatic-trump-vindictive-prosecution-claim\/\">voting machine company Smartmatic<\/a>, which plays a prominent role in Trump\u2019s conspiracy theories about his loss in the 2020 presidential election \u2014 to continue.<\/p>\n<p>Career prosecutors overseeing the Adani case believed that despite that broader retreat, the charges against the Indian billionaire should proceed. Their assessment appeared to have the backing of the Justice Department\u2019s top brass until the meeting last month, the people familiar with the current negotiations said.<\/p>\n<p>Adani\u2019s defense lawyers highlighted his promised investments in the U.S. during that meeting, two of the people familiar with the discussion downplayed the influence of that pledge on the Justice Department\u2019s decision to drop the case. They described it as only a small part of the defense\u2019s presentation, which was primarily focused on why Adani\u2019s lawyers thought the case against him would fail in court and was a worthy candidate for dismissal under the Trump administration\u2019s new posture toward such cases.<\/p>\n<p>Giuffra, in a filing earlier this year, sought dismissal of the SEC case, arguing the government\u2019s allegations had almost no connection to the United States and involved contracts awarded for a solar project in India with no American bidders.
