Comey described late Tuesday as a highly unusual effort to prosecute him over a social media post.<\/p>\n<p>Those new details emerged in <a href=\"https:\/\/movinginsiderusa.com\/wp-content\/uploads\/2026\/07\/181c15e338c2dbb63379e6b644a2e930.pdf\" rel=\"\" target=\"_self\" title=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nced.227449\/gov.uscourts.nced.227449.36.0.pdf\">a series of court filings<\/a> from Comey\u2019s defense team attacking the charges filed against him earlier this year over a photo he posted to Instagram of seashells spelling out \u201c86 47.\u201d<\/p>\n<p>The Justice Department has characterized the May 2025 post as a threat to President Donald Trump, saying that \u201c86\u201d is known slang for \u201cmurder\u201d and \u201c47\u201d refers to Trump, the 47<sup>th<\/sup> president of the United States. Comey has apologized for the posting but denied he had any violent intent, and derided the prosecution as an improper effort to target him for his vocal criticism of the president.<\/p>\n<p>The filings by Comey\u2019s defense include FBI <a href=\"https:\/\/movinginsiderusa.com\/wp-content\/uploads\/2026\/07\/01a9b7fadc02dba463fc73090f995702.pdf\" rel=\"\" target=\"_self\" title=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nced.227449\/gov.uscourts.nced.227449.40.1.pdf\">search warrant applications<\/a> for <a href=\"https:\/\/movinginsiderusa.com\/wp-content\/uploads\/2026\/07\/8f16b1f3616a3ee8b66e9ff2289bdf7d.pdf\" rel=\"\" target=\"_self\" title=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nced.227449\/gov.uscourts.nced.227449.40.2.pdf\">Comey\u2019s digital accounts<\/a>, <a href=\"https:\/\/movinginsiderusa.com\/wp-content\/uploads\/2026\/07\/d87242ff99c11e1a17c2d6680435e950.pdf\" rel=\"\" target=\"_self\" title=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nced.227448\/gov.uscourts.nced.227448.43.0.pdf\">memos detailing several interviews<\/a> conducted by agents and other government documents provided to Comey\u2019s defense team in preparation for trial. They provide the fullest account to date of the Justice Department\u2019s stop-and-start efforts over nearly a year to secure an indictment in the face of sustained pressure from the White House to charge Comey with a crime.<\/p>\n<p>\u201cAmple objective evidence \u2014 much of which comes directly from government officials\u2019 own public statements and admissions \u2014 establishes that the President\u2019s animus toward Mr. Comey led to this vindictive and selective prosecution,\u201d Comey\u2019s lawyers wrote.<\/p>\n<p>The Justice Department has not yet filed its formal response to Comey\u2019s claims.<\/p>\n<p>In the Tuesday filings, Comey\u2019s attorneys described \u201c86 47\u2033 as a \u201cslogan used to oppose President Trump.\u201d<\/p>\n<p>At one point, shortly after Comey took down the photo of the shells \u2014 which he has said he stumbled across while walking on a beach in North Carolina \u2014 a top Justice Department official ordered the Secret Service to surveil the former FBI director and his wife, the defense lawyers said. They said government documents showed Trump sought<b> <\/b>updates on that surveillance in real time as he returned from a foreign trip on Air Force One.<\/p>\n<p>The filings indicate that even as agents forged ahead with their investigation, they repeatedly struggled to find evidence to substantiate the central claim of their case: that in posting the photo Comey knowingly posed a \u201ctrue threat\u201d to the president.<\/p>\n<p>For instance, when an agent interviewed Gravano \u2014 a Gambino crime family member turned government cooperator \u2014 this spring in hopes he would back up their contention that \u201c86\u201d was well-known mafia slang, the mobster insisted, according to the defense filings, that \u201ca gangster would never use that term.\u201d<\/p>\n<p>Gravano did not indicate that he<b> <\/b>viewed Comey\u2019s seashell post as a threat to personally attack the president, according to a memo recounting that interview included in the defense filings. But he acknowledged that the former FBI director, who had prosecuted mob cases earlier in his career, would have likely heard the term \u201c86\u201d used with violent connotations previously.<\/p>\n<p>Gravano urged the investigators to speak to John Gleeson, a famed former New York mob prosecutor and contemporary of Comey\u2019s, to back up his assessment.<\/p>\n<p>It was not clear from the filings Tuesday whether the FBI followed up on that suggestion, but Comey\u2019s team did.<\/p>\n<p>\u201cThe claim that \u201886\u2019 is mafia jargon for \u2018kill\u2019 is preposterous,\u201d Gleeson, a former judge now in private practice, wrote in an affidavit included in the defense team\u2019s filings. \u201cIf it weren\u2019t made in the context of seeking to deprive a man of his liberty, it would be laughable.\u201d<\/p>\n<p>Federal agents also interviewed a person described in the filings Tuesday as an estranged former associate of Comey. Inside those 25 pivotal seconds.<\/a><\/p>\n<p>That person made clear from the start that she was not supportive of Comey and said she \u201choped he goes to jail\u201d for the \u201ccrimes he committed\u201d as FBI director. But she told agents she did not initially view Comey\u2019s post as threatening, and believed \u201c86\u201d was slang used among workers in the food service industry to describe when an item was taken off a menu.<\/p>\n<p>It was only after the person heard former Trump lawyer Rudy Giuliani on a podcast discussing the term in the context of the mafia that she began to believe the post could be seen as a call for violence, the person told agents, according to a summary of that interview included in the defense filings.<\/p>\n<p>At one point, agents even turned to artificial intelligence tools in hopes of finding support for the claim that \u201c86\u201d was mafia slang. The tool they used described that theory as an \u201curban legend,\u201d according to Comey\u2019s lawyers.<\/p>\n<p>Despite those setbacks, the investigation continued for nearly a year. Trump has repeatedly called for Comey to be charged with a crime. And that pressure only intensified after a previous Justice Department effort to prosecute the Comey for alleged false statements to Congress was thrown out before trial by a federal judge who concluded the U.S. attorney overseeing the case had been illegally appointed.<\/p>\n<p>In April, Trump fired Attorney General Pam Bondi in part over his frustration with the pace of her efforts to prosecute his perceived political enemies. The defense documents Tuesday show that the investigation of Comey\u2019s seashell post intensified shortly after her firing, under Bondi\u2019s replacement and former deputy, acting attorney general Todd Blanche.<\/p>\n<p>Though department officials had previously shopped the case to federal prosecutors in Virginia, it was the U.S. attorney\u2019s office in Raleigh, North Carolina, near the beach where Comey saw the seashell arrangement, that ultimately took up the case.<\/p>\n<p>FBI agents there applied for two search warrants to access Comey\u2019s electronic records in March and May. In them, they sought to undermine Comey\u2019s public apologies for the post, including during an appearance he made to explain the situation on \u201cThe Late Show with Steven Colbert.\u201d<\/p>\n<p>Investigators cited a <a href=\"https:\/\/slate.com\/human-interest\/2014\/11\/jimmy-kimmel-what-is-it-like-to-be-a-late-night-talk-show-guest-on-his-show.html\" rel=\"\" target=\"_self\" title=\"https:\/\/slate.com\/human-interest\/2014\/11\/jimmy-kimmel-what-is-it-like-to-be-a-late-night-talk-show-guest-on-his-show.html\">2014 Slate interview<\/a> with actress Darby Stanchfield, who starred in the TV show \u201cScandal,\u201d detailing how TV show guests often do \u201cpre-interviews\u201d with a show\u2019s producers to work out what they will say on air. Based on that account, the agent wrote, it was likely that Comey workshopped his apology for the seashell post before his appearance on Colbert\u2019s show.<\/p>\n<p>That assertion was included in one of the filings from Comey\u2019s defense team\u2019s Tuesday, as his lawyers accused<b> <\/b>prosecutors of twisting information and hiding other details from the magistrate judges who approved the warrants, including investigators\u2019 previous failed attempts to substantiate the violent meaning of \u201c86.\u2033 Those omissions, the attorneys said, should warrant dismissal of the case.<\/p>\n<p>Comey\u2019s lawyers have also sought dismissal on a number of other grounds, including that Comey\u2019s post was protected by the First Amendment and that the case amounts to an improperly vindictive prosecution driven not by the facts but by the president\u2019s animus toward Comey.<\/p>\n<p>The Justice Department is expected to file its formal response to Comey\u2019s claims early next month and<b> <\/b>a trial is currently scheduled for the fall.
